Sears, Magnolia business blamed for ruined floors, furniture
Sears and a Magnolia business are being sued over claims they caused $30,000 in damages to a Harris County home.
Frank Tamborella filed a lawsuit on Dec. 5 in Harris County District Court against Sears Roebuck, David Bishop, of Magnolia and doing business as Timber Designs Unlimited, and Gary Snider, doing business as Home Installation by Special D Services, citing gross negligence.
Tamborella says the defendants ruined the hardwood floors in his home, as well as some furniture and fixtures, after he purchased a refrigerator from Sears, located in the Baybrook Mall in Friendswood. According to the brief, the Sears installers damaged the floors and hired Designs Unlimited to repair them.
The suit alleges during reparation, Tamborella’s furniture and furnishes were ruined when Designs Unlimited employees stored them on the back porch and it rained.
Tamborella is seeking actual and exemplary damages, as well as attorney’s fees and court costs. He is being represented in the case by Kemah attorney Richard Morrison.
